Abstract
This paper examines the main problems that arise with the bankruptcy of the licensor or the licensee of an industrial property right of trade secret. Special attention is paid to the transfer of licensed rights within the insolvency proceedings, to the obligation to use the licensed assets, as well as to certain issues related to the exercise of civil actions for infringement of the licensed rights filed during the insolvency proceedings.
