Abstract
The corporate groups, both in the commercial sense and in the labour sense, have adopted the practice of drawing up a common equal opportunities plan for their affiliated companies. This makes it necessary to determine whether the collective bargaining of such a plan is lawful and, if so, to determine also, who has the social workers' capacity to negotiate. The jurisprudence has worked to integrate normative gaps caused by labour laws and the Ley orgánica 3/2007, de 22 marzo, para la igualdad efectiva de mujeres y hombres. However, this jurisprudence does not resolve the legal nature of the equal opportunities plan.
