Abstract

In February 2018, a few months before the end of the official transposition period of Directive (UE) 2016/681, of the European Parliament and of the Council of 27 April 2016, on the use of passenger name record (PNR) data for the prevention, detection, investigation and prosecution of terrorist offences and serious crimes, the Ministry of the Interior sent the Government the transposition rule of this Directive. The change of government produced in Spain in June 2018 has paralyzed this initiative, which, however, must be taken up by the new government so as not to breach the deadlines set by the European Union too much.The analysis of the preliminary draft is a good moment to question some of the proposals that can serve as a guide for the future legislator to approve a standard that satisfies all the expectations deposited in it.
