Abstract

The prohibition of approaching to the victim is an ancillary penalty and it has to impose, compulsory, by the judge, when a person is sentenced by domestic violence or gender-based violence. As result of these regulatory notes, the cases in which the victim consents to the breach of the prohibition have notably increased. The aim of this paper is to analyse the jurisprudence relating to the relevance of the victims’ consent with respect the criminal responsi-bility of both. As well, we will make some proposals for improving this situation.
